1. Acceptance
By creating an account or using the Kova app or kovadml.com, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be at least 18, legally able to enter a binding agreement and compliant with applicable Nigerian law. We may update these Terms; the current version will always be on this page, and continued use after a change means you accept it.
2. The service
Kova is a peer-to-peer marketplace that connects people who want to rent, buy, sell or exchange goods and services, with a focus on Nigerian campuses. The platform provides listing tools, in-app communication, identity verification, inspection scheduling, payment infrastructure and reporting tools.
3. Accounts and verification
- Provide accurate, current and complete information, and keep your login credentials secure.
- You are responsible for activity under your account. Tell us immediately if you suspect unauthorised access.
- We may require phone or NIN-based identity verification before certain activities or features. Verification uses NIMC records and authorised providers, as described in our Privacy Policy.
- Verified merchants may carry a blue or gold badge depending on their plan and checks completed. Badges confirm identity checks, not the quality or condition of a property or product.
- False, misleading or fraudulent information can lead to suspension or termination.
4. In-app communication
All communication between users should happen through Kova's in-app chat. Do not share external contact details in listings or messages, ask anyone to move a conversation off the app, or try to circumvent in-app communication.
We may review, log or preserve communications where needed for safety, enforcement, dispute resolution or legal compliance. We are not obliged to monitor every conversation or to mediate between users.
5. Listings and conduct
You may not list or attempt to trade:
- Illegal goods or services under Nigerian law.
- Stolen property or property obtained by fraud.
- Weapons, explosives or hazardous materials without proper licensing.
- Drugs, controlled substances or drug paraphernalia.
- Counterfeit or pirated goods, or items that infringe intellectual property.
- Adult content or services.
- Pyramid schemes, multi-level marketing or get-rich-quick schemes.
You also agree not to:
- Commit fraud, harass others, threaten or abuse anyone.
- Impersonate another person or create fake accounts.
- Manipulate ratings, reviews or reputation systems.
- Interfere with the platform or other users' access to it.
- Circumvent fees or use unauthorised bots, scrapers or data collection.
Report violations through the in-app reporting tools. We review reports and may act at our discretion, but we do not have to take a particular action or disclose every enforcement decision.
6. Payments, fees and taxes
Kova may earn revenue from transaction commissions, merchant subscription fees and other disclosed fees. Applicable rates and plan details are shown in the app before you commit.
Payments made through Kova's integrated payment features are processed by Paystack. Unless expressly stated for a specific transaction type, Kova does not hold funds in escrow and is not responsible for payment disputes, chargebacks or non-payment between users.
Fees are separate from taxes. You are responsible for your own tax obligations, licences and regulatory compliance. We may change fees or subscription pricing with reasonable notice; continued use after a change means you accept it.
7. Safety
Inspect a property before you pay. Check the address, the water, the power and the terms. Meet in a safe place, keep the conversation in the app, and use in-app payment features where available so the transaction has a record.
Verification reduces risk but does not eliminate it. You are responsible for evaluating listings, people and transactions, and for using your own judgement.
8. Content and intellectual property
Kova and its licensors own the platform, including its software, design, text, graphics and logos. You may not copy, modify, reverse engineer or redistribute the platform, or use our branding without written permission.
You keep ownership of the content you post. By posting it, you give Kova a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt and display that content to operate and promote the platform.
9. Suspension, liability and disclaimers
We may suspend or terminate accounts, remove content or restrict access where we believe these Terms have been broken, where there is fraud or risk, or where the law requires it. You may stop using Kova at any time.
The service is provided “as is” and “as available”. To the fullest extent permitted by Nigerian law, Kova disclaims liability for the quality, safety, legality or accuracy of listings; for the ability of users to pay or deliver; and for disputes between users. Our total liability for claims relating to the platform will not exceed the fees you paid to Kova in the three months before the claim.
You agree to indemnify Kova against claims, losses and costs arising from your use of the platform, your content, your violation of these Terms or your infringement of another person's rights.
10. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes arising from these Terms or the platform will be resolved by arbitration under the Arbitration and Conciliation Act (Cap. A18), with one arbitrator, seated in Delta State, Nigeria, in English. By accepting these Terms, you agree to that process.
Kova is not obliged to mediate disputes between users. You are encouraged to resolve them directly or seek independent legal advice.
If any provision is found unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of it. These Terms, the Privacy Policy and any policies referenced here form the whole agreement between you and Kova.
